richiamata l'ordinanza 19 agosto 2002 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta;
vista la lettera 26 agosto 2002 della parte ricorrente che comunica il ritiro del ricorso;
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
