richiamata l'ordinanza 3.5.02 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta (II);
vista la lettera 14.8.02 della parte ricorrente che comunica il ritiro del ricorso (IV);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
