The Tribunal cantonale delle assicurazioni dealt with an appeal against two decisions of the cantonal compensation fund concerning supplementary benefits. Before the respondent had filed its answer, the appellant withdrew the appeal because the fund had meanwhile issued new decisions granting the requested relief. The court held that the case had become moot and ordered it removed from the docket. It further decided that no court fees or costs would be collected.
Withdrawal of the appeal and supervening mootness render the proceedings devoid of object; in such circumstances the appellate court may strike the case from the docket. Where the dispute has been resolved by subsequent administrative decisions in the appellant’s favour, no substantive adjudication is required and costs may be waived in view of the termination of the proceedings (consid. 1-2).

in materia di prestazioni complementari
letti ed esaminati gli atti;
richiamata l'ordinanza 23 agosto 2000 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta;
rilevato che la parte ricorrente con scritto 21 settembre 2000 comunica di ritirare il gravame, avendole la Cassa, nel frattempo, intimato due nuove decisioni che accolgono le richieste ricorsuali;
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
