The appellant challenged two decisions of 23 February 2000 concerning supplementary benefits. Before filing its response, the compensation fund issued two new decisions on 25 October 2000 that fully accepted the appeal's requests and annulled the challenged decisions. The appellant then withdrew the appeal. The Cantonal Insurance Court held that the case had become moot and struck it from the docket. It ordered no court fees or costs and awarded the appellant CHF 400 in party compensation.

Art. 3/a cpv. 1 of the cantonal procedure law on appeals in social insurance matters; reconsideration by the administrative authority and mootness of the appeal. Until transmission of its response, the administrative authority may reconsider the challenged decision and replace it by a new one. If, after such reconsideration, the appellant withdraws the appeal because the new decisions fully satisfy the claims, the appeal becomes devoid of object and is struck off the roll. In that constellation, the court may waive court fees and costs and award party compensation according to the outcome of the proceedings.

letti ed esaminati gli atti;

visto in particolare lo scritto della parte convenuta che precisa di aver emesso in data 25 ottobre 2000 due nuove decisioni (cfr. Doc. _) con le quali vengono integralmente accolte le conclusioni dell'atto di ricorso e vengono annullate le precedenti decisioni qui impugnate;

ricordato che, ai sensi dell'art. 3/a cpv. 1 della Legge di procedura per i ricorsi al Tribunale cantonale delle assicurazioni in materia di assicurazioni sociali, l'Autorità amministrativa può, fino all'invio della sua risposta, riesaminare la decisione impugnata;

ritenuto che comunque anche la parte ricorrente, con scritto 4 novembre 2000 (cfr. Doc. _), ha comunicato il ritiro del ricorso aderendo alle nuove decisioni della cassa;

rilevato che di conseguenza il gravame è divenuto privo di oggetto;

decreta 1. il ricorso di cui sopra è stralciato dai ruoli;

  1. non si percepiscono né tasse né spese; la cassa verserà alla parte ricorrente fr. 400.- a titolo di ripetibili;

intimazione alle parti a sensi ed effetti di legge.
