The appellant appealed an invalidity insurance decision of 1 February 2001. After the respondent filed its answer, the appellant's representative informed the court on 28 August 2001 that the appeal was being withdrawn. The Ticino Cantonal Insurance Court therefore found that the case had become moot and ordered it struck from the docket. It also ordered that no fees or costs be charged.
Withdrawal of appeal; mootness and costs in social insurance proceedings. Where the appellant withdraws the appeal before the court rules, the proceedings lose their object and are to be struck from the docket. In such circumstances, and absent special reasons, no court fees or expenses are charged (consid. 1-2).
