viste le lettere 23 luglio e 24 settembre 2001 con cui il convenuto ha comunicato al Tribunale di ritirare l'opposizione formulata contro la decisione risarcitoria notificata;
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
