sedente con il cancelliere Giovanni Pozzi in qualità di segretario, per statuire sul ricorso 5 ottobre 2004 presentato da

RI 1

contro

la decisione n° __________ del __________ emessa dalla Sezione della circolazione, Camorino,

viste le osservazioni presentate dalla Sezione della circolazione, Camorino

letti ed esaminati gli atti;

considerato in fatto ed in diritto

  1. La Sezione della circolazione con decisione __________ ha inflitto a RI 1 una multa di fr. 40.-, oltre la tassa di giustizia di fr. 20.- e le spese di fr. 10.-, per aver posteggiato a Lugano il veicolo __________ fuori dai posti delimitati.

  2. Contro la predetta pronuncia dipartimentale la ricorrente si aggrava ora davanti a questo giudice chiedendone l'annullamento.

  3. La Sezione della circolazione propone di annullare in ordine la decisione 1° ottobre 2004 non essendo stato possibile provare l'avvenuta intimazione del rapporto di contravvenzione.

  4. Di conseguenza il ricorso deve essere accolto, senza addentrarsi nel merito del gravame, riservata la facoltà della sezione della circolazione di riprendere ex novo la procedura.

pronuncia: 1. Il ricorso 5 ottobre 2004 è accolto.
