The President of the Pretura penale heard an appeal against a decision of the Sezione della circolazione concerning a traffic contravention. The appellant showed that the fine had been paid within the deadline indicated in the police report. On that basis, the court held that the challenged decision could not be maintained. The appeal was therefore admitted, the administrative decision was annulled, and no court fees or costs were imposed.
Art. 1 segg. LPContr; where the contravener pays the fine within the deadline indicated in the police contravention report, the later decision based on that contravention lacks a continuing basis and must be annulled. The appeal is therefore upheld and no costs are charged (consid. 1).
