The President of the Pretura penale decided an appeal against a 5 December 2003 decision of the Sezione della circolazione. After the traffic authority itself proposed, in a letter of 17 December 2003, that the challenged decision be annulled, the court annulled that decision. It also ordered that no court fees or costs be charged.
Administrative appeal; annulment of the challenged decision at the request of the issuing authority. Where the authority that rendered the impugned decision proposes its annulment, the appellate court may decree annulment without further substantive determination; in such a case, costs may be left uncharged.
