The president of the Pretura penale ruled on an appeal against a 5 December 2003 decision of the Sezione della circolazione. Since the traffic authority subsequently proposed annulment of its own decision, the court annulled the challenged decision and ordered that no fees or costs be collected.
Administrative appeal; where the competent authority, after the filing of the appeal, expressly proposes annulment of the challenged decision, the appellate court may annul that decision without entering into the merits. In such a situation, the proceedings are resolved by annulment of the contested act and the allocation of no fees or costs, as reflected in the dispositive order.
