__________ SA challenged a decision of the Sezione della circolazione before the Pretura penale. Before the court ruled, the traffic authority asked that its own decision be annulled. The President of the Pretura penale therefore annulled the challenged decision, struck the appeal from the docket, and ordered that no fees or costs be taken.
When the authority whose decision is challenged requests annulment of its own decision before the appeal is decided, the appellate court may annul the challenged decision and strike the appeal from the roll as moot; in such circumstances, no fees or costs need be levied (consid. 1-2).
