The President of the Pretura penale of Bellinzona decided on an appeal against a traffic-authority decision. After the Sezione della circolazione requested annulment of its own decision by letter of 24 February 2003, the court annulled the challenged decision and struck the appeal from the docket. It also ordered that no court fees or expenses be taken.

When the authority withdraws or requests annulment of the challenged administrative act during pending proceedings, the court may dispose of the appeal by annulling the contested decision and removing the case from the docket, with costs left unapplied where expressly ordered.
