Art. 347 cpv. 1 lett. b CPP; installment payment of a criminal fine and costs: the judge of the Pretura penale is competent to authorize payment by installments and to fix the amount and maturity dates when the convicted person is unable to pay the full sum at once. The grant of installment payment is justified where the file sufficiently establishes the debtor’s inability to make a lump-sum payment (consid. 1).

per il reato di infrazione alle norme della circolazione, circolazione in stato di ebrietà
reati previsti dagli art. 90 Cifra 1 LCS, art. 91 cpv. 1 LCS
ed ora per statuire sull’istanza 31 gennaio 2004 con la quale __________ chiede di poter ottenere una rateazione del pagamento di fr. 2'000.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflittagli con il decreto menzionato;
considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento della somma di fr. 2'000.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflitta con DA __________/__________del __________ 2003, in 4 rate mensili, la prima volta entro il 31 marzo 2004.
