The President of the Pretura penale granted the convicted person's request to pay CHF 1,500, corresponding to the fine, court fee and judicial costs, in six monthly instalments. The court found the debtor unable to pay the amount in a single payment and relied on Art. 347 para. 1 let. b CPP to authorize instalment payment. The first instalment must be paid by 30 April 2004.
Art. 347 cpv. 1 lett. b CPP; instalment payment of a criminal fine and costs may be authorized when the convicted person is unable to pay the amount in a single instalment. The judge of the Pretura penale is competent to fix the instalments and due dates. If the inability to pay immediately is established from the file, the request may be granted and payment spread over monthly instalments (consid. 1).

reato previsto dall'art. 91 cpv. 1 LCS
ed ora per statuire sull’istanza __________ __________ 2004 con la quale __________ __________ chiede di poter ottenere una rateazione del pagamento di fr. 1'500.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflittagli con il decreto menzionato;
considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento della somma di fr. 1'500.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflitta con DA __________/__________del ____________________ 2003, in 6 rate mensili, la prima volta entro il 30 aprile 2004.
