The Pretura penale of Bellinzona considered the Public Prosecutor's request to convert an unpaid fine into arrest. The convicted person had been fined CHF 300 by an earlier DAP decree, but the amount remained unpaid and collection attempts failed. After the person did not appear at the citation hearing, the court applied the statutory conversion rate of one day of arrest per CHF 30 and ordered 10 days of arrest.
Art. 49 cifra 3 CP; art. 347 CPP: commutation of an unpaid fine into arrest. Where a fine remains unpaid and enforcement attempts fail, the competent authority may order commutation according to the statutory conversion rate of one day of arrest per CHF 30 of fine, subject to the statutory maximum of ninety days. The convicted person's non-appearance does not preclude the measure where the prerequisites are otherwise met (consid. 1).
