The President of the Pretura penale ruled on the Public Prosecutor’s request to convert an unpaid fine into arrest. A prior decree had imposed a CHF 100 fine on the condemned person, but payment was not made and collection attempts failed. After the condemned person did not appear, the court applied the statutory conversion rate and ordered that the fine be commuted into 3 days of arrest.
Art. 49 cifra 3 CP; Art. 347 CPP; conversion of an unpaid fine into arrest. Where a fine remains unpaid and enforcement attempts are unsuccessful, the court may order conversion into arrest at the statutory rate, subject to the maximum duration. The conversion is a consequence of non-payment and ineffective collection; once the prerequisites are met, the request of the prosecuting authority is admitted and the custodial substitute sentence is fixed by arithmetical application of the legal ratio.

considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
