The President of the Pretura penale of Bellinzona considered an application by a convicted driver who had been fined in a prior decree for driving in a state of drunkenness. Because the file showed that he could not pay the total amount at once, the court authorized payment of the CHF 1,700 debt in six monthly installments, with the first installment due by 30 November 2003. The Ministry Public was notified.
Art. 347 cpv. 1 lett. b CPP; installment payment of a criminal monetary sanction and related costs may be authorized when the convicted person is unable to pay the full amount at once. The Pretura penale has competence to grant the facility and to fix the number of installments and their due dates. The decisive criterion is the debtor’s actual payment capacity as shown by the file (consid. 1).

considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
