The President of the Pretura penale granted the execution authority’s request to convert an unpaid criminal fine into arrest. A fine of CHF 400 had previously been imposed by DAP decree; only CHF 104 had been paid and collection of the remaining CHF 296 had failed. Applying the statutory conversion rate of one day of arrest per CHF 30, the court ordered conversion of the residual amount into 9 days of arrest.
Art. 49 cifra 3 CP; Art. 347 CPP: commutation of an unpaid fine into arrest; if recovery of the outstanding balance proves unsuccessful, the court converts the residual amount at the statutory rate of one day of arrest per CHF 30, subject to the maximum term of ninety days. The conversion concerns only the unpaid balance of the fine and is ordered by the execution judge upon request of the competent execution authority.

richiamato il decreto DAP / del __________ __________ 2002, mediante il quale gli è stata inflitta una multa di fr. 400.--;
rilevato che la multa è stata pagata solo in ragione di fr. 104.-- e che ogni tentativo di incasso del residuo è risultato infruttuoso;
citat il giorno ____________________ 2003;
considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
richiamati gli art. 49 cifra 3 CP e 347 CPP,
pronuncia 1. L'istanza del IS0 di commutazione della multa in arresto è accolta.
Di conseguenza il residuo di fr. 296.-- della multa di fr. 400.-- inflitta a __________ __________ __________, con decreto numero DAP / di data ____________________ 2002, è commutato in 9 giorni di arresto.
