The Pretura penale noted that the convicted person had paid the fine in full. It therefore ordered that the pending proceedings for commutation of the fine into arrest be struck off the roll and served the order on the parties.
Fine-to-arrest commutation proceedings; where the fine has been paid in full, the basis for substitution disappears and the proceedings are to be struck off as moot, since the coercive measure sought is no longer justified.
