The President of the Pretura penale of Ticino dealt with a request from the Public Prosecutor to convert an unpaid fine into arrest. The convicted person, who had previously been fined CHF 50 by a 2001 enforcement-and-penalty decree, did not pay and did not appear at the hearing. As collection attempts failed, the court applied the conversion rate of one day of arrest for CHF 30 of fine and ordered the fine commuted into one day of arrest.
Art. 49 cifra 3 CP, art. 347 CPP; commutation of an unpaid fine into arrest. Where a fine remains unpaid and enforcement measures prove unsuccessful, the execution judge may convert the fine into deprivation of liberty at the statutory conversion rate of one day of arrest per CHF 30 of fine, subject to the maximum duration provided by law. The debtor’s non-appearance does not preclude conversion when the statutory prerequisites are met (consid. implicit).

citata la condannata il giorno 11 febbraio 2003, non è comparsa;
considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
