The Bellinzona Pretura penale granted the Public Prosecutor’s application to convert an unpaid fine into arrest. After a CHF 500 deposit had been made and recovery of the remaining CHF 1,000 had failed, the court ordered commutation at the statutory rate of one day of arrest per CHF 30, resulting in 33 days of arrest.
Art. 49 cifra 3 CP; Art. 347 CPP: where a fine remains unpaid and enforcement of the balance proves unsuccessful, the court may commute the outstanding amount into arrest at the statutory conversion rate, subject to the maximum duration provided by law. The commutation follows from the failure of collection attempts and is calculated proportionally on the unpaid residue; partial payments or deposits reduce the amount to be converted (consid. implicit).
