The President of the Pretura penale of Ticino ruled on a convicted person's request to pay a total of CHF 1,500, consisting of a fine, court fee, and judicial costs, in installments. Finding that the person could not pay the amount in one lump sum, the court granted the request and allowed payment in 8 monthly installments, the first due by 30 June 2003. The Public Prosecutor was notified.
Art. 347 cpv. 1 lett. b CPP; installment payment of a criminal fine and related costs may be authorized when the convicted person is unable to pay in a lump sum. The judge of the Pretura penale is competent to fix both the number of installments and their due dates. The assessment is based on the debtor’s actual payment capacity as shown by the file; if inability to pay immediately is established, the request is to be granted and the enforcement schedule determined accordingly.

per il reato di infrazione grave alle norme della circolazione, circolazione in stato di ebrietà, contravvenzione alla LF sugli stupefacenti
reati previsti dagli art. 90 Cifra 2 LCS, art. 91 cpv. 1 LCS, art. 19a LS
ed ora per statuire sull’istanza 2 maggio 2003 con la quale __________ __________ __________ chiede di poter ottenere una rateazione del pagamento di fr. 1'500.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflittagli con il decreto menzionato;
considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento della somma di fr. 1'500.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflitta con DA __________/__________del __________ 2003, in 8 rate mensili, la prima volta entro il 30 giugno 2003.
