The convicted person applied for permission to pay CHF 2,000, comprising the fine, court fee and judicial costs imposed by an earlier criminal decree, in installments. The President of the Pretura penale held that he was competent to grant such relief under Art. 347(1)(b) CPP and found that the applicant could not pay the amount in one lump sum. The request was therefore approved, and payment was allowed in eight monthly installments, the first due by 30 April 2003.
Art. 347 cpv. 1 lett. b CPP; installment payment of a criminal fine and costs may be authorized by the president of the pretura penale when the convicted person is unable to discharge the amount in one lump sum. The court fixes both the number of installments and their maturity dates; the grant of such relief is a matter of execution of the sentence, not a modification of the conviction (consid. 1).

considerato che: - giusta l’art. 347 cpv. 1 lett. b) CPP, il giudice della Pretura penale è competente a concedere al condannato la facoltà di pagare la multa a rate e a fissarne l’importo e le scadenze;
richiamato l’art. 347 CPP,
decreta: 1. In accoglimento dell’istanza è concesso il pagamento della multa di fr. 2'000.-- pari alla multa, tassa di giustizia e spese giudiziarie, inflitta con DA __________/__________del __________ 2003, in 8 rate mensili, la prima volta entro il 30 aprile 2003.
