The President of the Pretura penale in Bellinzona ordered the striking-out of criminal enforcement proceedings seeking conversion of a fine into arrest. The court found that the penalty imposed by the 1999 DAP decree was already prescribed under Arts. 109 and 75 no. 2 CC. The decision therefore ended the conversion procedure and ordered notification to the parties.
Arts. 109 and 75 no. 2 CP; conversion of a fine into arrest where the underlying penalty is prescribed: once prescription has occurred, enforcement by way of conversion is no longer admissible. The court must strike the conversion proceedings from the docket ex officio when the penalty can no longer be enforced due to time bar.
