The Ticino Civil Cassation Chamber held that a civil cassation appeal under Art. 327 CPC lies only against judgments of justices of the peace and pretors sitting as sole instance. A decision of the Cantonal Administrative Court is not subject to this remedy because that court is not a civil judicial authority. The appeal filed on 12 August 1998 was therefore inadmissible. Given the specific circumstances, the court waived costs and judicial fees, which rendered the request for legal aid moot.

che decisioni del Tribunale cantonale amministrativo –che non è autorità giudiziaria civile– mai potrebbero rientrare nelle competenze di questa Camera;

che, a prescindere da ogni altra considerazione, il ricorso non è ricevibile;

che la particolarità della fattispecie giustifica di non prelevare spese né tassa di giustizia;

che pertanto diviene priva d’oggetto la domanda di assistenza giudiziaria presentata dal ricorrente;

pronuncia: 1. Il ricorso per cassazione 12 agosto 1998 di ___________ è inammissibile.
