The Civil Cassation Chamber of the Ticino Court of Appeal dealt with a cassation appeal against a 30 May 1996 judgment of the Justice of the Peace of Bellinzona. The president had ordered the appellant to pay a CHF 100 advance on costs by 26 August 1996, with the warning that non-payment would cause the appeal to be deemed deserted under Art. 312 CPC. As the deadline passed without payment, the court struck the appeal from the docket and ordered that no court fees or justice costs be taken.
Art. 312 CPC; failure to pay the court-ordered advance on costs within the set time limit leads, after prior warning, to the appeal being struck off the roll as deserted. Ritenuto in fatto e considerato in diritto:
che in data 8 agosto 1996 il presidente di questa Camera ha assegnato alla ricorrente un termine scadente il 26 agosto 1996 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 100.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
che il termine in questione è trascorso infruttuoso;
richiamato l’art. 312 cpv. 2 CPC
decreta 1. Il ricorso 5 giugno 1996 di __________, __________ avverso la sentenza 30 maggio 1996 del Giudice di pace del circolo di Bellinzona, è stralciato dai ruoli per mancato versamento dell'anticipo.
Non si prelevano tasse nè spese di giustizia.
