The president of the Ticino enforcement and bankruptcy chamber, acting as supervisory authority, ruled on a complaint accompanied by a request for suspensive effect. By order of 14 May 2003, the request for suspensive effect was granted. The order also states that, until the complaint is decided, enforcement acts and measures may proceed, and service is to be made to the parties through the competent enforcement/bankruptcy office.
Art. 36 LEF; Art. 10 and Art. 24a LPR; suspensive effect of a supervisory complaint: the supervisory authority may grant suspensive effect on request. The dispositive may, however, regulate the continuation of enforcement measures pending the complaint, so that the interim procedural regime follows the court’s express operative directions (consid. not indicated).
