The complainant challenged the Lugano debt enforcement office in several enforcement files. During the supervisory proceedings, the creditors withdrew all the enforcement actions. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal held that the appeal had thereby become moot and ordered it struck from the docket. It also decided not to levy court costs and not to award compensation. A further appeal to the Federal Supreme Court was indicated within ten days under the Debt Enforcement and Bankruptcy Act.
Art. 20a cpv. 1 LEF; mootness of a supervisory complaint after withdrawal of the enforcement proceedings. If the contested enforcement proceedings are withdrawn during the supervisory complaint, the complaint loses its object and must be struck off the roll. In such a situation, and where the applicable tariff provisions so provide, no court fee is levied and no party compensation is awarded (art. 61 cpv. 2 lett. a and art. 62 cpv. 2 OTLEF; consid. not indicated).
