The president of the Ticino debt-enforcement and bankruptcy chamber, acting as supervisory authority, decided a complaint accompanied by a request for suspensive effect. The request was formally granted. However, the order also states that, until the complaint is decided, enforcement acts and measures may continue. Notification to the parties was ordered through the competent enforcement/bankruptcy office.
Art. 36 LEF; Art. 10 and 24a LPR: suspension of enforcement pending complaint proceedings. The operative scope of the stay must therefore be derived from the dispositif as a whole and may be limited by express reservations (consid. only operative order).
