The supervisory chamber of the Ticino Court of Appeal dealt with an appeal against the conduct of the enforcement office in Locarno. Before the court ruled, the appellant withdrew the appeal in writing. The chamber held that the proceeding had therefore become devoid of object and ordered the case struck from the docket. It further decided that no court costs would be collected and no indemnity would be awarded. The decision indicates that a further appeal to the Federal Supreme Court was available within ten days through the same chamber.
Art. 20a LEF; Art. 61 et 62 OTLEF: when a supervisory complaint or appeal is withdrawn, the proceedings become devoid of object and are struck off the docket. In such a case, absent special reasons, no costs or indemnities are awarded. The decision is procedural and does not address the merits of the enforcement-office conduct.
