The Ticino supervisory chamber dealt with an appeal against a bankruptcy warning issued by the Bellinzona enforcement office. While the appeal was pending, the office annulled the challenged warning. The chamber held that the appeal had thereby lost its object and ordered it struck from the roll. It further decided that no costs and no indemnities would be charged. The decision also indicated the possibility of further appeal to the Swiss Federal Tribunal within ten days.
Art. 20a cpv. 1 primo periodo LEF; Art. 61 cpv. 2 lett. a and Art. 62 cpv. 2 OTLEF: if the challenged enforcement act is revoked during the pendency of a supervisory complaint, the complaint becomes devoid of object and must be struck off the roll. The absence of a live dispute precludes a merits ruling; the prior unchallenged revocation extinguishes the subject matter of the proceedings. In such circumstances, the supervisory authority may order that no costs or compensation be awarded, depending on the applicable costs rules.

ritenuto che il pregresso provvedimento, munito dell’indicazione dei mezzi di ricorso non è stato impugnato;
considerato come il gravame sia così divenuto privo di oggetto;
richiamati gli art. 20a cpv. 1 primo periodo LEF, 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF
pronuncia:
Il ricorso 20 luglio 2000 di __________, è stralciato dai ruoli, poiché divenuto privo di oggetto.
Non si prelevano spese, né si assegnano indennità.
Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
