The cantonal supervisory authority in bankruptcy received a filing styled as a request to close a bankruptcy for lack of assets. It held that the filing was in substance a request for suspension for lack of assets. Because Art. 230 para. 1 SchKG assigns such requests to the bankruptcy judge, the supervisory authority lacked competence. The request was therefore declared inadmissible and the file was transmitted ex officio to the competent district court.

Art. 230 cpv. 1 LEF; competence for suspension of bankruptcy for lack of assets: a request for suspension must be addressed to the bankruptcy judge and not to the cantonal supervisory authority. Where a filing is mislabeled as a request for closure but is materially a request under Art. 230 LEF, the authority must assess its substance. If competence is lacking, the supervisory authority shall declare the filing inadmissible and transmit the file ex officio to the competent court; see consid. on competence and transmission.
