The Ticino supervisory chamber in debt enforcement dealt with an appeal against a realization request issued by the Locarno debt enforcement office. After suspensive effect had been granted, the appellant withdrew the appeal through counsel. The court held that the appeal had become moot and struck it from the docket. It also ordered that no costs be charged and no indemnity be granted.
Art. 61 cpv. 2 lett. a and 62 cpv. 2 OTLEF; withdrawal of the complaint in supervisory proceedings on debt enforcement renders the appeal moot and justifies striking it from the roll. Where the proceeding is discontinued for withdrawal, the court may order that no costs be taken and no indemnity be awarded, absent further substantive adjudication (consid. 1-2).
