The supervisory complaint filed on 30 December 1996 against the conduct of the special bankruptcy administration was withdrawn on 20 January 1997. The CEF therefore held that the dispute had become moot and struck the complaint from the docket. It also ordered that no costs be collected and no compensation be granted. A further remedy to the Swiss Federal Tribunal was indicated under Art. 19 LEF.

Art. 61 cpv. 2 lett. a and 62 cpv. 2 OTLEF; withdrawal of a supervisory complaint and loss of the object of dispute. Where the complainant withdraws the complaint, the supervisory authority strikes the matter from the docket as moot. In such circumstances, the proceedings are terminated without a merits determination; as a rule, no costs or indemnities are awarded absent special grounds. The decision is subject to the remedy provided by Art. 19 LEF (consid. 1-3).

richiamati gli art. 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF

pronuncia

  1. Il reclamo 30 dicembre 1996 ____________________, è stralciato dai ruoli per intervenuto ritiro.

  2. Non si prelevano spese e non si assegnano indennità.

  3. Contro questa decisione è dato ricorso entro 10 giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale, Losanna 14, in conformità dell’art. 19 LEF.
