Résumé

AP 1 appealed a first-instance bankruptcy judgment. Before this appeal was decided, the same appellate chamber had already issued another judgment in a related appeal declaring AP 1 bankrupt from a later date. The chamber therefore held that the present appeal had lost its object and ordered it stricken from the docket. The justice fee of CHF 50 was imposed on AP 1. Copies were notified to the parties and relevant offices.

Mootness of an appeal in bankruptcy proceedings; where a subsequent appellate judgment on the same bankruptcy matter renders the challenged decision without practical object, the appeal is struck from the docket as devoid of purpose. The losing appellant bears the court fee (consid. 1-2).

da martedì 15 novembre 2005 alle ore 14.00.

Decisione dedotta in appello da AP 1 che con atto 24 novembre 2005

ne postula l’annullamento;

rilevato che con sentenza 9 dicembre 2005 questa Camera, decidendo un precedente

appello, ha dichiarato il fallimento di AP 1 a far tempo da martedì

13 dicembre 2005 alle ore 10.00 (inc. 14.2005.122);

ritenuto come la presente procedura sia così divenuta priva d’oggetto;

pronuncia:

1.L’appello 24 novembre 2005 di AP 1, __________, è stralciato dai ruoli nel senso dei considerandi.

2.La tassa di giustizia di fr. 50.-- è posta a carico di AP 1.
