Résumé Omnilex

The Camera di esecuzione e fallimenti of the Ticino Court of Appeal held that the debtor’s 18 February 2004 letter did not amount to a valid appeal against the Lugano Pretura judgment granting definitive objection removal. Because the writing did not express an intention to obtain a more favorable second-instance decision and did not identify the challenged points, the appellate proceeding lacked a proper gravamen and was struck out for lack of object. The court also ordered that no court costs or justice fee be charged.

Regeste Omnilex

Art. 25 LALEF; art. 309 CPC; appeal in debt-enforcement proceedings: a second-instance remedy exists only if the filing, made in time, contains a clear declaration of appeal and identifies the points of the judgment contested. A mere reaction to the judgment, even if disagreeing with its reasoning, does not suffice when it does not evince the will to obtain a more favorable appellate decision. In the absence of a valid gravamen, the appellate court cannot decide the merits and must strike the proceeding off the roll for lack of object (consid. 1).

La Camera di esecuzione e fallimenti del Tribunale d'appello

composta dei giudici:

Pellegrini, vicepresidente, Chiesa e Giani

segretaria:

Baur Martinelli, vicecancelliera

statuendo sulla causa a procedura sommaria appellabile promossa con istanza 6 novembre 2004 da

AP1

tendente a ottenere il rigetto definitivo dell'opposizione interposta al PE n. __________

del 27/28 ottobre 2003 dell'UE di Lugano;

  1. La tassa di giustizia in fr. 160.-, da anticipare dalla parte istante, è posta a carico della parte convenuta con l'obbligo di rifondere a controparte fr. 280.- a titolo di indennità";

visto lo scritto 18 febbraio 2004 inviato dall'escusso alla Pretore, ritenuto in un primo tempo come impugnazione della menzionata sentenza;

preso atto che l'istante non ha presentato osservazioni;

ritenuto

in fatto e in diritto:

che, in virtù dei combinati art. 25 LALEF e 309 CPC, dev'essere considerato appello soltanto la tempestiva impugnazione di una decisione pretorile che, tra l'altro, contenga la dichiarazione di appellare con l'indicazione precisa dei punti della sentenza impugnata che si intendono dedurre dinanzi alla seconda istanza;

che lo scritto citato, trasmesso dalla Pretura a questa Camera, non esprime nemmeno la volontà della parte di appellare (Cocchi/ Trezzini, CPC-TI, art. 309, m. 6), ossia di ottenere dall'istanza superiore un giudizio a lei favorevole, tant'è che essa -pur non condividendo le conclusioni del primo giudice- afferma testualmente di voler ossequiare lo stesso giudizio;

che non v'è pertanto ragione per decidere alcunché in assenza di gravame, dovendo così stralciare la procedura d'appello per mancanza d'oggetto (art. 351 cpv. 1 CPC per analogia);

decreta:

  1. L'atto 18 febbraio 2004 (di cui ai considerandi) è stralciato dai ruoli.

  2. Non si prelevano spese né tassa di giustizia.

  3. Intimazione: - __________

Question juridique clé

Whether the debtor's 18 February 2004 letter constituted a valid appeal against the first-instance judgment.

Solution extraite

The letter was not a valid appeal because it did not express a clear intention to seek a favorable second-instance judgment or indicate the challenged points.

Motifs extraits

Under Art. 25 LALEF and Art. 309 CPC, an appeal requires a timely challenge and an express declaration of appeal identifying the points contested. The letter merely stated that the debtor would comply with the judgment, so there was no proper gravamen.

Question juridique clé

Whether the appeal proceedings should continue despite the absence of a proper appeal.

Solution extraite

No. In the absence of a valid appeal, there was nothing for the appellate court to decide and the proceeding had to be struck from the docket for lack of object.

Motifs extraits

Without a gravame, the appellate court cannot rule on the merits; the case is removed from the roll by analogy to Art. 351 cpv. 1 CPC.

Question juridique clé

Whether court costs or a justice fee should be charged in the appellate proceeding.

Solution extraite

No costs and no justice fee were imposed.

Motifs extraits

Given the absence of a substantive appeal and the striking out of the proceeding, the court ordered no court costs or justice fee.
