"1. È pronunciato il fallimento del signor __________ a far tempo dal giorno 3 dicembre 2003 alle ore 14.30.

2./3./4. Omissis."

Sentenza dedotta tempestivamente in appello da __________ che con atto

12 dicembre 2003 ne postula l'annullamento;

rilevato che la parte appellata non ha presentato osservazioni;

preso atto che con ordinanza presidenziale 19 dicembre 2003 all'appello

è stato concesso effetto sospensivo parziale;

ritenuto

in fatto:

A. Con istanza 30 ottobre 2003 la __________ ha chiesto il fallimento di __________ per Fr. 4'536.25 oltre interessi e spese.

B. All'udienza di contraddittorio del 28 novembre 2003 nessuno è comparso.

C. Il 3 dicembre 2003 la Pretore della Giurisdizione di __________ ha pronunciato il fallimento di __________ a far tempo dal 3 dicembre 2003 alle ore 14.30.

D. Con atto d'appello 12 dicembre 2003 __________ ha postulato la declaratoria di nullità del decreto di fallimento, sostenendo di avere pagato il debito in oggetto direttamente alla rappresentante della creditrice e producendo una ricevuta 27 novembre 2003 della __________ relativa al versamento di fr. 4'700.-- a saldo dell'esecuzione n__________ (doc. _).

Considerato

In diritto: 1. Per l'art. 174 cpv. 1 LEF la decisione del giudice del fallimento può essere deferita all'autorità giudiziaria superiore entro dieci giorni dalla notificazione. Le parti possono avvalersi di fatti nuovi, se questi si sono verificati anteriormente alla decisione di prima istanza.

  1. L'appellante adduce di avere saldato il debito in oggetto anteriormente alla dichiarazione di fallimento. A sostegno del suo assunto liberatorio __________ ha prodotto quanto indicato nella narrativa fattuale sub D. Questo documento costituisce prova sufficiente del pagamento effettuato ante dichiarazione di decozione dell'esecuzione in esame n. __________. Di conseguenza il fallimento di __________ va annullato ex art. 174 cpv. 1 LEF.

  2. L'appello 12 dicembre 2003 di __________ va quindi accolto.

La tassa di giustizia è posta a carico dell'appellante in ambo le sedi (art. 49 OTLEF), non essendo lo stesso comparso avanti alla prima giudice e non avendo quindi prodotto in tale sede il documento topico. Non si assegnano indennità non avendo la parte appellata presentato osservazioni (art. 62 cpv. 1 OTLEF).

Le spese dell'Ufficio fallimenti sono caricate all'appellante.

Per questi motivi,

richiamato l'art. 174 cpv. 1 OTLEF

pronuncia:

I. L'appello 12 dicembre 2003 di __________ è accolto.

"1. La dichiarazione di fallimento 3 dicembre 2003 pronunciata dalla Pretore della Giurisdizione di __________, inc. EF. __________, nei confronti di __________ è annullata.

  1. La tassa di giustizia di prima sede di fr. 80.--, da anticipare come di rito, è posta a carico di __________.

  2. Le spese dell'Ufficio esecuzione e fallimenti di __________, da anticipare come di rito, sono poste a carico di __________."

II. La tassa di giustizia di fr. 120.-- del presente giudizio, già anticipata dall'appellante, resta a carico di __________.

III. Intimazione:
