The Chamber of debt enforcement and bankruptcy of the Ticino Court of Appeal allowed the debtor’s appeal against a bankruptcy declaration issued by the Lugano district judge. The debtor produced documents showing payment of the claim before the bankruptcy ruling, including a receipt and the creditor’s written acknowledgment of full settlement. The court held that this was sufficient proof of extinction of the debt and annulled the bankruptcy. It nevertheless left the first-instance and appellate court fees, as well as the bankruptcy office costs, on the appellant, and awarded no compensation.

Art. 172 no. 3 and 174 para. 1 DEBA; bankruptcy declaration and proof of payment before the first-instance decision. The bankruptcy judge must reject the petition, or the appellate court must annul the declaration, when the debtor proves by documentary evidence that the debt, including interest, was extinguished before the decision. On appeal, new facts are admissible only if they predate the first-instance ruling. Documentary proof may consist of a receipt and a creditor’s acknowledgment of full payment. Costs may nevertheless be charged to the debtor under the applicable fee rules, especially where the debtor did not appear before the first judge.

sulla quale istanza la Pretore del Distretto di Lugano, Sezione 5, con sentenza 30 maggio 2000 ha così deciso:

" 1. È pronunciato il fallimento della __________, a far tempo da martedì 30 maggio 2000 alle ore 14.00

2./3./4. Omissis"

Sentenza tempestivamente dedotta in appello il 9 giugno 2000 dalla __________ che ne postula l'annullamento;

richiamato il decreto presidenziale 13/20 giugno 2000 che ha accordato all'appello effetto sospensivo parziale;

ritenuto

in fatto:

A. Con istanza 28 gennaio 2000 la __________ ha chiesto il fallimento della __________ per fr. 4'425.65 oltre accessori e dedotti eventuali acconti.

B. All'udienza di contraddittorio del 12 aprile 2000 nessuno è comparso.

C. L'appellante adduce di avere saldato il suo debito prima della pronuncia del fallimento, producendo una ricevuta 2 febbraio 2000 per fr. 2'500.-- (doc. A) e una datata 15 maggio 2000 sempre della creditrice, in cui quest'ultima ha dichiarato di avere ricevuto dalla __________ fr. 2'262.65 a saldo dell'esecuzione in oggetto n. 702'432 (doc. B).

D. La creditrice non ha presentato osservazioni.

considerato

in diritto:

  1. Giusta l'art. 172 n. 3 LEF il giudice rigetta la domanda di fallimento quando il debitore provi con documenti che il debito compresi gli interessi è stato estinto.

Per l'art. 174 cpv. 1 LEF la decisione del giudice del fallimento può essere deferita all'autorità giudiziaria superiore entro dieci giorni dalla notificazione. Le parti possono avvalersi di fatti nuovi, se questi si sono verificati anteriormente alla decisione di prima istanza.

  1. L'appellante adduce per la prima volta in sede d'appello di avere saldato il suo debito prima della declaratoria di fallimento. A sostegno del suo assunto liberatorio ha prodotto quanto indicato nella narrativa fattuale sub C. Questi documenti costituiscono prova sufficiente dell'avvenuto pagamento ante declaratoria di decozione: il fallimento va quindi annullato ex art. 174 cpv. 1 LEF.

  2. La tassa di giustizia è posta a carico dell'appellante, non essendo comparsa avanti al primo giudice, in ambo le sedi (art. 49 OTLEF).

Non si assegnano indennità (art. 62 cpv. 1 OTLEF).

Le spese dell'Ufficio fallimenti sono caricate all'appellante.

Per questi motivi,

richiamati gli art. 171, 172 e 174 LEF

pronuncia:

I. L'appello 9 giugno 2000 __________ è accolto.

"1. La dichiarazione di fallimento 30 maggio 2000 pronunciata dalla Pretore del Distretto di Lugano, Sezione 5, inc. __________ nei confronti della __________, è annullata.

  1. La tassa di giustizia di prima sede di fr. 80.--, da anticipare come di rito, è posta a carico della __________.

  2. Le spese dell'Ufficio dei fallimenti di Lugano, da anticipare come di rito, sono poste a carico della __________ ".

II. La tassa di giustizia di fr. 120.-- del presente giudizio, già anticipata dall'appellante, resta a suo carico.

III. Intimazione: - __________;

Comunicazione alla Pretura del Distretto di Lugano, Sezione 5.
