The Ticino Court of Appeal’s Second Civil Chamber considered an appeal against a 6 May 2004 decision of the Pretore of Lugano, section 3. After ordering an advance on costs of CHF 2,500 and warning that non-payment by 1 July 2004 would cause the appeal to be declared deserted under Art. 312 CPC, the appellant paid only on 6 July 2004. The chamber held the deadline to be peremptory and struck the appeal from the docket. It also charged the appellant with CHF 50 in court costs.
Art. 312 CPC; late payment of an advance on costs in appeal proceedings: where the appellate court sets a peremptory deadline for the advance and warns of non-entry or strike-out in case of non-payment, payment after expiry of the deadline does not cure the default. The appeal is to be removed from the docket as procedurally deserted; the appellant bears the resulting court costs (consid. on timeliness and peremptory character of the time limit).

richiamata la diffida 8 giugno 2004 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 1° luglio 2004 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 2500.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
considerato come il versamento sia stato effettuato solo il 6 luglio 2004 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,
decreta 1. L'appello 1° giugno 2004 di APPE1 avverso la decisione 6 maggio 2004 del Pretore del Distretto di Lugano, sezione 3, è stralciato dai ruoli per versamento tardivo dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.

Yes. The deadline for payment was treated as peremptory, so the late payment made the appeal invalid for purposes of proceeding.
