The employer asked for return of company keys, postal-box keys, and a Lexus vehicle used by the employee. The first instance partially granted the request. On appeal, the employee argued he did not possess the keys and that the car had been gifted to him. The appellate court found his position on the keys inconsistent with his earlier lawyer’s statement and held that the vehicle registration documents supported the employer’s ownership. The appeal was dismissed, the return order was upheld, and the appellant had to pay CHF 500 in appeal compensation, with no court fees levied.

An employee must comply with the employer’s instructions and hand back company objects in his possession at the end of the employment relationship. Where the employer produces registration documents for a vehicle, this creates an indicium of ownership that is not displaced by a mere assertion of donation or by the possibility of private use. A party’s later denial of possession may be discredited by prior inconsistent statements, especially where earlier correspondence acknowledged retention of the items in an employment capacity.

in materia di contratto di lavoro (riconsegna di oggetti e beni da parte del lavoratore) che il Pretore, con sentenza 7 ottobre 2003, ha parzialmente accolto ordinando al convenuto di riconsegnare alla ditta istante tutte le chiavi della ditta, le chiavi della casella postale e l'autovettura Lexus IS 200 targa __________.

Appellante il convenuto il quale, con atto d'appello 20 ottobre 2003, chiede la riforma del primo giudizio nel senso di respingere integralmente l'istanza di controparte mentre questa, con osservazioni 28 ottobre 2003, chiede la reiezione dell'appello e la conferma della sentenza pretorile.

Letti ed esaminati gli atti ed i documenti di causa

Considerato

in fatto ed in diritto

che il Pretore, dopo aver osservato che il lavoratore, ai sensi degli art. 321a e 321d CO, deve osservare le direttive generali e le istruzioni particolari che gli vengono date dal datore di lavoro, ha ritenuto provata la proprietà dell'istante sull'autovettura Lexus, a suo tempo consegnata al dipendente per le necessità della sua attività lavorativa, ed ha ordinato a quest'ultimo, sussistendo tra le parti al momento della decisione ancora il contratto di lavoro pur assente il dipendente per malattia, di riconsegnarla;

che altrettanto ha fatto per le chiavi dell'ufficio e della casella postale che appartengono pacificamente alla datrice di lavoro;

che il convenuto, con l'appello, afferma che nulla prova che egli sia in possesso delle chiavi reclamategli, circostanza contestata in sede di udienza di discussione, e che l'autovettura Lexus gli è stata donata percui nulla deve restituire;

che, per quanto riguarda le chiavi, l'appellante si pone in contraddizione con le argomentazioni addotte, prima dell'inoltro della procedura giudiziaria, quando chiesto di restituire le chiavi rispose, tramite il suo legale, che, siccome ancora dipendente dell'istante, egli le teneva per sé appunto in tale funzione e senza, invece, minimamente accennare al fatto di non disporne (cfr. lettera doc. 3);

che, con riferimento all'autovettura, l'istante ha dimostrato documentalmente (doc. C) di essere la titolare del permesso di circolazione e quindi di godere dell'indizio di esserne proprietaria (Schaffhauser, Grundriss des schweizerischen Strassenver- kehrsrechts, 1984, Band I N. 141 e seg.) che non può essere intaccato dall'affermazione, rimasta tale, dell'appellante che l'autovettura gli era stata donata, non potendo dimostrare ciò il fatto che la poteva usare anche per scopi privati;

che ne discende come l'appello debba essere respinto con il carico di indennità ripetibile all'appellante;

Per i quali motivi

dichiara e pronuncia

  1. L'appello 20 ottobre 2003 di AP1 è respinto.

  2. Non si prelevano tasse o spese. L'appellante verserà alla controparte Fr. 500.- per ripetibili d'appello.
