The Second Civil Chamber of the Ticino Court of Appeal decided on the appellant’s request for suspensive effect in an appeal against a 24 June 2003 decision in a special wage proceeding. It found the request appropriate and granted suspensive effect to the appeal. The decree only addressed the interim stay of enforcement and was communicated to the first-instance court.
Art. 398 cpv. 2 and art. 310 cpv. 4 lett. e CPC; suspensive effect on appeal: where the appeal seeks a stay of the challenged decision, the appellate court may grant suspensive effect when the circumstances make such stay appropriate. The measure is an interim procedural order and does not prejudge the merits of the appeal.

decreta 1. All’appello 7 luglio 2003 di cui sopra, è accordato effetto sospensivo.
Comunicazione alla Pretura della giurisdizione di Mendrisio nord.
