The Second Civil Chamber of the Ticino Court of Appeal struck the appellant’s appeal from the docket because the court-ordered advance on costs of CHF 750 was not paid within the deadline. The appellant had been warned that failure to pay would lead to the appeal being declared deserted under Art. 312 CPC. The court also ordered CHF 50 in court costs against the appellant.
Art. 312 CPC; failure to pay ordered advance on costs within the fixed deadline justifies striking an appeal from the docket. Where the appellant is duly warned that non-payment will lead to the appeal being declared deserted, expiry of the deadline without payment results in procedural extinction of the appeal; the appellate court may then allocate the costs of the proceeding to the defaulting appellant (consid. implicit).

richiamata la diffida 13 giugno 2003 del presidente di questa Camera mediante la quale all'appellante veniva assegnato un termine scadente il 7 luglio 2003 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 750.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, l'appello sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 24 maggio 2003 di __________, avverso la decisione 2 maggio 2003 del Pretore del Distretto di Riviera, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
Intimazione:
Comunicazione alla Pretura del Distretto di Riviera.
