The plaintiff appealed a first-instance order requiring a CHF 75,000 procedural security deposit under Art. 153 CPC. Before the appellate court ruled on the merits, the appellant filed a written withdrawal of the appeal. The Second Civil Chamber of the Ticino Court of Appeal therefore struck the appeal from the roll and ordered that no court fees or expenses be collected.
Withdrawal of an appeal terminates the appellate proceedings and leads to the appeal being struck from the roll; absent special circumstances, no court fees or costs are levied when the court so orders. The appellate court does not examine the merits once the appellant has validly withdrawn the remedy.
