The Second Civil Chamber of the Ticino Court of Appeal suspended an appeal while the parties negotiated an out-of-court solution. After the appellant informed the court that a settlement had been reached, he requested that the appeal be struck off. The court granted the request, removed the appeal from the docket, charged the CHF 100 court fee to the appellant, and ordered compensation of party costs.
Art. 351 CPC; strike-off of appeal proceedings after extrajudicial settlement. Where the appellant informs the appellate court that the parties have reached an agreement and requests discontinuance, the court may remove the proceedings from the roll. In such a case, the procedural costs may be charged to the appellant, while party costs may be compensated, in accordance with the applicable cantonal tariff rules (consid. 1-2).

è stralciata dai ruoli.
