In a civil appeal against a first-instance order striking the case from the docket and charging costs to the plaintiff, the appellant informed the Court of Appeal that the parties had settled and that the appeal was withdrawn. The second civil chamber therefore struck the appeal from the docket for withdrawal. It ordered the appellant to bear the already advanced court fee and expenses, totalling CHF 250, and set off party costs.
Civil appeal; withdrawal after settlement; costs. If the appellant withdraws the appeal after the parties have settled, the appellate court strikes the appeal from the docket. In such a situation, the court may leave the judicial fee and expenses to the withdrawing appellant and order compensation of ripetibili, unless a different cost allocation is justified by the circumstances (cf. cost ruling under the LTG; see also consid. on withdrawal).

che il Pretore, con decreto 16 febbraio 1999 ha stralciato dai ruoli ai sensi degli art. 351 e 352 CPC caricando le spese e la tassa di giustizia, nella misura di quanto già anticipato, all’attrice con l’obbligo di rifondere a controparte Fr. 2’500.- per ripetibili.
Appellante l’attrice la quale, con atto di appello 4 marzo 1999, chiede l’annullamento del decreto di stralcio
Ed ora sullo stralcio della procedura d’appello avendo l’appellante comunicato, con lettera 29 marzo 1999, che tra le parti si è addivenuti ad un accordo transattivo con la conseguenza che lo stralcio della procedura di prima istanza ed il ritiro di quella ricorsuale non comportano addebito di ripetibili alla controparte, spese e tasse a chi le ha anticipate.
Vista per le spese la LTG
pronuncia
L’appello 4 marzo 1999 è stralciato dai ruoli per desistenza.
La tassa di giustizia in Fr. 200.- e le spese di Fr. 50.- (totale Fr. 250.-) già anticipate dall’appellante rimangono a suo carico, compensate le ripetibili.

The appeal was struck out of the docket because the appellant withdrew it.
The appellant notified the court that the parties had reached a settlement and that the first-instance striking-out and the withdrawal of the appeal should not entail ripetibili against the respondent.
