The appellant withdrew the appeal by letter of 1 April 1999. The Second Civil Chamber of the Ticino Court of Appeal held that the proceeding had thereby become moot and ordered the appeal of 1 February 1999 struck off the docket. It also ordered that no court fees or costs be collected.
Appeal withdrawn; mootness of the proceedings leads to striking the appeal from the docket. Where the appellant expressly withdraws the appeal, the appellate court need not decide the merits and may declare the procedure devoid of object; in such circumstances it may order the appeal removed from the docket and waive the taking of court fees and costs (consid. only implicit).
