Résumé

The Second Chamber of Civil Law of the Court of Appeal noted that the dispute underlying the appeal had been settled out of court. On that basis, it held that the appellate proceedings had become moot and ordered the appeal struck from the docket. The court also decided that no fees or costs would be collected. The decision was issued by President Cocchi, with Judges Chiesa and Zali, and Clerk Petrini.

Art. 351 CPC and related procedural rules; mootness of appeal after extrajudicial settlement. Where the parties resolve the dispute pending appeal, the appellate proceedings lose their object and are to be removed from the docket. In such a situation, the court may order that no taxes or costs be levied, particularly when the proceedings terminate without a substantive adjudication on the merits (consid. implicit).
