The plaintiffs appealed a judgment of the Pretura of Locarno-Campagna that had fully rejected their claim concerning a co-ownership share. The Court of Appeal first suspended the appeal proceedings, then received notice that the parties had concluded a settlement and that the appellants were withdrawing the appeal. The appeal was therefore struck out of the docket, and the court costs and expenses of CHF 250 already advanced by the appellants were left to them.
Appeal withdrawal after settlement; the appellate court, upon notice that the parties have settled and the appellant withdraws the appeal, strikes the appeal from the docket. In such a situation, the procedural consequence is termination of the appeal without a merits review; the costs and expenses already advanced may be left to the withdrawing appellants (cf. dispositive no. 2).

Avendo il Presidente di questa Camera sospeso, con ordinanza 8 settembre 1999, la procedura d'appello.
Ritenuto che, con scritto 2 novembre 1999, il patrocinatore degli attori e appellanti ha comunicato che le parti sono addivenute ad un accordo transattivo e che, di conseguenza, l'appello viene ritirato.
pronuncia
L'appello 30 giugno 1999 è stralciato dai ruoli.
La tassa di giustizia di Fr. 200.- e le spese di Fr. 50.- (totale Fr. 250.-), già anticipate dagli appellanti, rimangono a loro carico.
