In an appeal concerning provisional measures to secure a possible reassignment of transferred patents, the parties reached a settlement while the appellate proceedings were suspended in view of an amicable solution. On 23 February 2001, counsel requested that the appeal be struck from the roll. The Second Civil Chamber of the Court of Appeal accordingly removed the appeal from the docket under Art. 352 CPC and, pursuant to the settlement, ordered the judicial fee and expenses of CHF 250 to be borne half by each side, with party costs set off.
Art. 352 CPC; settlement during appeal proceedings and striking out from the roll; where the parties settle the dispute pending appeal, the appellate court removes the case from the docket. If the settlement also regulates costs, the court gives effect to that arrangement, including equal sharing of fees and expenses and compensation/set-off of party costs, unless mandatory rules require otherwise.

con la quale gli attori hanno chiesto l'adozione di provvedimenti cautelari tendenti ad assicurare un'eventuale riassegnazione di brevetti ceduti che il Pretore, con decisione 14 giugno 1999, ha accolto.
Ed ora sull'appello 25 giugno 1999 dei convenuti che chiedevano la riforma del giudizio del Pretore nel senso di respingere le chieste misure cautelari.
Sospesa, con ordinanza 24 dicembre 1999, la trattazione della procedura d'appello in vista di una soluzione bonaria della vertenza.
Vista la comunicazione 23 febbraio 2001 del patrocinatore degli istanti che chiede lo stralcio della procedura a seguito dell'intervenuta transazione tra le parti che prevede pure l'accollo di tasse e spese di giudizio alle parti per metà ciascuna e la compensazione delle indennità ripetibili.
In applicazione dell'art. 352 CPC
decreta
L'appello 25 giugno 1999 nella procedura inc. no. 12.1999.00134 è stralciato dai ruoli per transazione.
La tassa di giudizio di Fr. 200.- e le spese in Fr. 50.- (totale Fr. 250.-), già anticipate dagli appellanti, sono a carico delle parti in ragione di metà ciascuna, compensate le ripetibili.
