In a second-instance civil appeal concerning a debt-disavowal action, the parties concluded a settlement after the appeal had been filed. The Second Civil Chamber of the Tribunal d'appello therefore struck the appeal proceedings from the docket. It further ordered that the total court fees and expenses of CHF 100, already advanced by the appellant, be borne equally by both parties. Art. 351 CPC; striking out appeal proceedings after settlement: when, during the appeal stage, the parties conclude a settlement, the appellate court may remove the case from the docket. The settlement, if attached and incorporated into the dispositive act, terminates the appellate proceedings without a merits determination. Costs are then allocated according to the settlement or, absent specific agreement, by application of the ordinary cost rules and the applicable tariff, typically allowing an equal division where appropriate (consid. on the striking-out and costs).

Sospesa la procedura d'appello ai sensi dell'art. 107 CPC, con ordinanza 14 febbraio 1996, avendo la parte appellante presentato nel frattempo alla pretura istanza di restituzione in intero contro la sentenza a' sensi degli art. 346 e seg. CPC.
Ed ora, sullo stralcio della procedura a dipendenza dell' accordo transattivo concluso tra le parti ed allegato al presente decreto quale parte integrante;
in applicazione degli art. 351 e sgg. CPC ed in ossequio alla vigente Tariffa Giudiziaria,
decreta:

transazione tra le parti.
